Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CursorHop desktop application, website (cursorhop.com), and related services (collectively, the "Service") provided by CursorHop ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our End-User License Agreement (EULA). If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Terms

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• You are responsible for all activity that occurs under your account.
• You may not use the Service for any illegal or unauthorized purpose.
• One person or legal entity may maintain no more than one free trial. Multiple free trial accounts for a single person or entity are not permitted.

3. License and Access

CursorHop grants you a personal, non-transferable, non-exclusive license to use the Application on the number of computers specified by your plan tier:

• Pro ($15) — 2 devices, all features
• Pro Plus ($30) — 5 devices, all features
• Max ($60) — 10 devices, all features, priority support

A free trial is available with full Pro features (2 devices, all features) so you can evaluate the Application before purchasing. Paid licenses are perpetual — they do not expire. You receive 12 months of free updates from the date of purchase.

4. Payment Terms

• Pro, Pro Plus, and Max plans are one-time purchases. There are no recurring charges, subscriptions, or annual renewal fees.
• All prices are listed in USD.
• Payment is processed securely through Stripe. We do not store your credit card information.
• You will receive an email receipt for every purchase.
• Prices are subject to change. Any price changes will not affect existing license holders.

5. Purchases and Free Trial

A free trial with full Pro features is available so you can evaluate CursorHop before purchasing. All purchases are final. Since you have the opportunity to fully test the Application through the free trial before committing to a purchase, no refunds are provided.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Infringe upon or violate the intellectual property rights or privacy rights of others
• Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to any portion of the Service or any connected system or network
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service to distribute malware, viruses, or other harmful software
• Circumvent any technical limitations or security measures of the Service

7. User Content

The Service enables you to share content (files, clipboard data, text) between your devices. You retain all ownership rights to content you share. We do not claim ownership over any content transmitted through the Service.

Content transfer occurs directly between your devices over your local network. We do not access, monitor, store, or transmit your content through our servers.

8. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of CursorHop. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

10. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. The core functionality of the Application (mouse/keyboard sharing, file transfer) operates locally and does not depend on our servers being available.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that the Service will function uninterrupted, secure, or error-free, or that any defects will be corrected.

13. Limitation of Liability

In no event shall CursorHop, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless CursorHop and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or your violation of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, through email notification. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
